Well I had to pay the access to get the car, I have a list of emails asking about guarantees on the work done. Senna motors Boksburg wrote on the invoice that no guarantees will be given on the work, as they only took the heads of and out them back again. no work was done.
You should read the report from the engineer, he claims I towed the vehicle to the water and then phoned the insurance.
I wrote Tuff Stuff a long letter stating the points of his findings that I do not agree to. I just feel like I'm going to be left here with a car that's gonna cost me a lot of money to repair.

I agree with Gerhard - it is clear that you are going to carry the full brunt of the problem if you do not obtain legal aid here.
I suggest you get supporting statements from guys that were present when you dipped swartskaap.

Every time I read his report I have to take a time out, it gets my blood pumping beyond what i think is healthy.
I have not had a reply from tuff stuff yet, but will follow it up. I hate lawyers, their the only ones making money in a case. but it seems I do not have choice in the matter at the moment.
The car is being fully evaluated again at Mitsubishi Specialist. They're doing a quote for the interior, coolant flush and a full electronic diagnostic.
They will also on my demand do a quote to get the car going again as normal, with the report from the engineer Tommie.
Something is tickling me though.
The car was standing for 24 days with the engine being taken out before the engineer saw it. They claim the torque converter had no oil in it. I get that the car cant move without this oil. Now I know we were playing to hearts desire before she stopped moving and sucked water. Where could the oil have gone? the gearbox was left in place, but the engine was taken out.
Does the box have to be full, or will it operate with a little oil?? this seems the engineer's whole case. the oil in the torque converter.
The car was loaded backwards on a flatbed when it was towed. I know she didn't leak any oil, a little sweat here and there, I know I had a main bearing seal that needed to be replaced in the near future.

if you had no oil in the torque converter the car won't move. End of story.

Get over your dislike of lawyers - you need a good one at this very moment!
As Anton said, get sworn statements from 'witness' you had at the water crossing, stating that the vehicle drove under it's own power, with no apparent problem, until you dunked it.
This is crucial, because it will blow the "Engineer's" report (that you broke it before the dunking) out of the water.

- The vehicle had no problem until the dunking. This implies that the transmission had adequate oil in it.
- You did not drain the oil, so somebody else did.
- The engineer could well be correct that there was no oil in the torque converter. That fact does not imply that you drained the oil. The court will have to prove that you did.
- The problems with the engine cannot be tied to the problems with the transmission.
I shall Pm you guys the report. and some additional information that the engineer got wrong from the word go.

Our immediate concern is to get the vallet done and have arranged that vehicle be taken to Benoni Vallet to strip and do what is neccesary. We can then get vehicle back to Mits. Tech and resolve other issues.

Update...
Got it back from the Valet, still a bit of a mouldy smell but a lot better..
Now some new issues, the starting in park or neutral is getting worse.
She died on me on the highway at a 100km/h three times today. scary cause then nothing works, ABS, power steering etc.
The traction control and skid control light stays on and the engine management light also came on today.
There is definitely somethig wong with traction control even in Lowrange.
when I stop at a robot the engine tents to just die. This happens regardless of whether I'm in Drive or Neutral.
She still smokes like steam train. and my wife's 1.3 Yaris made me look like an old C2 citroen last night between two robots.
I am truly worried about all this now, as the Senna motors refused to give any kind of warranty on the work they have done on the engine, as they claim they only replaced the gaskets.
